1. Statutory right of withdrawal (Consumers)
If you are a consumer (a natural person), under Romanian Emergency Ordinance (OUG) 34/2014 you have the right to withdraw from the contract within 14 calendar days from the date you receive the product, without giving any reason and without penalty.
2. How to exercise the right of withdrawal
- Send a written notice to office@mbt.ro before the 14-day period expires
- The notice must contain: order number, identification details, products being returned, IBAN for refund
- You may use the model withdrawal form set out in the Annex to OUG 34/2014 (see section 7 below)
- We will send you an acknowledgement of receipt of your notice by e-mail
- Return the products to: MASCHINENBAU TIMISOARA SRL, Calea Stan Vidrighin nr. 5A, Platforma Industriala Bega, 300571 Timisoara, Romania
3. Return conditions
- The products must be in their original condition: undamaged, unmodified, unused (or used only as necessary to verify their nature and operation)
- The original packaging must be preserved as far as possible
- Return together with the products: the invoice, accompanying documents, accessories, manuals, warranty certificates
- The cost of returning the products is borne by the Buyer (transport)
4. Exceptions to the right of withdrawal
Under art. 16 of OUG 34/2014, the right of withdrawal does NOT apply to:
- Products made to the Buyer’s specifications or clearly personalised
- Products which, after delivery, are inseparably mixed with other items
- Sealed products which cannot be returned for reasons of health protection or hygiene, if they have been unsealed
- Services fully performed at the express request of the Consumer
5. Refund
- We will refund in full the amounts paid, including standard delivery costs (but NOT additional costs if you chose express delivery)
- Deadline: maximum 14 calendar days from the date we receive your withdrawal notice
- We may defer the refund until we receive the returned goods or until you provide proof of shipment
- The refund will be made using the same payment method used for the purchase, unless we agree otherwise
6. Defective or non-conforming products
If the product is defective or does not conform to its description, you have the right (under Law 449/2003 and OUG 140/2021) to:
- Free repair or replacement
- A proportionate price reduction
- A full refund, if the remedies above are not possible or have failed
The response time for a complaint is maximum 15 working days. The statutory conformity warranty is 2 years from delivery.
