2. Acceptance of these Terms

Use of the mbt.ro website (hereinafter the “Site”) and placing an order implies full acceptance of these Terms and Conditions. If you do not agree, please do not use the Site.

3. Definitions

Buyer: a natural or legal person who places an order
Consumer: a natural person acting for purposes outside their commercial activity (OG 21/1992)
Order: an electronic document by which the Buyer expresses the intention to purchase Products
Contract: the distance contract concluded between the Seller and the Buyer, without their simultaneous physical presence
Product: goods listed on the Site (machine tools, consumables, accessories)
RFQ: Request For Quotation – a request for an offer for customised or high-value products

4. Products and prices

Prices shown on the Site are expressed in RON or EUR and include VAT (21%) where applicable
For high-value or customised products, the final price is communicated through a written quotation (RFQ)
We reserve the right to change prices without prior notice. The applicable price is the one displayed at the time the order is placed
Product images are for information only; the delivered product may show minor differences from the image
In the event of an obvious price error (e.g. a price of 1 RON for a product worth thousands of RON), the Seller is entitled to cancel the order and refund any amounts received in full

5. Order and conclusion of the contract

The order process:

You select products and add them to the cart
You enter delivery and billing details
You choose a payment method
You confirm the order by clicking the “Place order” button
You receive an automatic confirmation e-mail (notification of receipt of order)
The contract is deemed concluded when we send you the order acceptance confirmation and/or when we dispatch the products

We reserve the right to refuse an order in case of: unavailable stock, incorrect contact details, suspected fraud, atypical order (unrealistically large quantities).

6. Payment methods

Bank transfer (BACS): according to the details provided at checkout and in the confirmation e-mail. The order is processed after receipt of payment is confirmed.
Online card payment (Stripe / PCI-DSS certified processor) – when available

7. Delivery

We deliver within Romania and the European Union by courier or, for heavy machinery, via transport arranged by MBT
Full rates and current delivery conditions are published on the Shipping page. That page is the canonical source and prevails over any rate references in other sections
Standard delivery time is 1-3 working days in Romania and 3-7 working days in the EU for consumables in stock; for machine tools or customised products, the delivery time is communicated individually
The risk of loss of the goods passes to the Buyer upon handover to the courier / receipt at the Buyer’s premises
On receipt, please verify the integrity of the parcel. In case of damage, refuse the parcel or note your observations on the transport document

8. Right of withdrawal (Consumers – OUG 34/2014)

If you are a Consumer (a natural person), you have the right to withdraw from the Contract within 14 calendar days from the date you receive the products, without giving any reason.

How to exercise the right: send a written notice to office@mbt.ro before the deadline expires. You may use the model withdrawal form set out in the Annex to OUG 34/2014, or any other clear statement.

Return conditions:

The products must be in their original condition, undamaged, unmodified
The original packaging must be preserved as far as possible
Tax documents (invoice) must be returned with the product
The cost of return is borne by the Consumer

Exceptions to the right of withdrawal (art. 16 OUG 34/2014): customised products, sealed products that cannot be returned for hygiene reasons, products which by their nature become inseparably mixed with other items.

Refund: within a maximum of 14 days from receipt of the withdrawal notice, using the same payment method used for the purchase. The Seller may defer the refund until the returned products are received.

9. Warranty

Statutory conformity warranty (Law 449/2003 and OUG 140/2021): 2 years from delivery for new products, for Consumers
Manufacturer’s commercial warranty (MEBA, Peddinghaus, Zinser, Songu etc.): according to the warranty certificate issued with the product
To activate the warranty, contact office@mbt.ro with the invoice and a description of the defect
The warranty does not cover: normal wear and tear, damage caused by improper use, unauthorised modifications, accidents

10. User account

Creating an account is optional; orders may also be placed as a guest
You are responsible for the confidentiality of your login credentials
The information you provide must be true and up to date
We reserve the right to suspend or delete accounts that violate these Terms

11. Intellectual property

All Site content (text, images, logos, design, source code) is protected by Law 8/1996 on copyright and related rights. Reproduction, distribution, modification or commercial use without written consent is prohibited.

The MEBA, Peddinghaus, Zinser, Songu and other trademarks belong to their respective owners. MBT is an authorised distributor in Romania.

12. Limitation of liability

The Site is provided “as is”. We do not warrant that it will be available uninterrupted or error-free
We are not liable for indirect losses, loss of profit or loss of data
Our total liability towards the Buyer shall not exceed the value of the Order
These limitations do not apply where applicable law prohibits the limitation of liability (e.g. personal injury, wilful misconduct)

13. Personal data protection

Personal data is processed in accordance with the GDPR (EU 2016/679) and Law 190/2018. Details: Privacy Policy.

14. Dispute resolution

Any disputes will be settled amicably. If that fails:

Consumers may contact the National Authority for Consumer Protection (ANPC), www.anpc.ro
EU Online Dispute Resolution (ODR) platform: consumer-redress.ec.europa.eu
As a last resort, disputes will be settled by the competent courts in Timisoara, in accordance with Romanian law

15. Changes to these Terms

We reserve the right to amend these Terms. The applicable version is the one displayed on the Site at the time the Order is placed.

17. Force Majeure

Neither party shall be liable for delays or failure to perform its obligations caused by a force majeure event (natural disasters, war, pandemic, embargo, major infrastructure outages, binding governmental decisions). The affected party must notify the other within 5 business days of the event occurring. If the event persists for more than 60 days, either party may terminate the Contract without damages. Applicable in accordance with art. 1351 of the Romanian Civil Code.
